دور الفنون في نصرة قضايا الأمة| فن الرسم، الكاريكاتير، الخط ( الجزء الخامس ) - منار الإسلام Anyone who examines the rulings of Sharia regarding various issues will easily reach a devastating conclusion: this Sharia is contrary to the Universal Declaration of Human Rights, especially Article 5, which states: “No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment ” Therefore, the Arab states that signed this document must distance themselves from Sharia and from the principle that Sharia must be the primary source of positive laws, because positive laws based on the Universal Declaration of Human Rights are incompatible with that Sharia , Signing the Universal Declaration of Human Rights means committing to its contents, They sign but do not commit, and this is called deception and trickery, These deceitful and tricky pseudo-states should withdraw from the United Nations, or this membership will be withdrawn from them one day. 

 We will not go into detail about all the limits imposed by Sharia, but we will mention some aspects of it that express its dual lack of any correct understanding and concept, for example, of justice and equality, Sharia9(religious law) did not keep justice as justice nor equality as equality, and Sharia was unable to differentiate between justice and fairness, It was also unable to separate the organic difference between women and men, for example in procreation, from equality in rights such as the right of inheritance. It was unable to consider the equality of Muslims with non-Muslims in the state as justice, but rather considered it injustice, “Is the believer equal to the disbeliever?!” Thus, Sharia was unable to get rid of religious racism, and became the effective means of destroying the internal peace necessary for the growth, continuity and stability of the state, since the state negates itself when it is unfair to equality between one citizen and another according to his religious affiliation.

   Through Sharia, equality between citizens is eliminated on several levels: on the level of men and women, on the level of Muslims and non-Muslims, and even on the level of Heaven and Hell, Ibn Abdullah observed the abundance of women in Hell and their scarcity in Heaven, Ibn Abdullah did not explain the reasons for this disparity., Is this disparity related to women being deficient in intellect and religion, or to them being guilty for being women, or are there other reasons that we are unaware of? And how did Ibn Abdullah observe this? Did he visit Hell, or was he a false witness?

Sharia does not differentiate between justice and equity, nor between equality and parity, i.e., similarity, nor between reason and transmission, i.e., transmitting texts without thinking about their contents, Sharia eliminates logic, eliminates reason and morals, and gives the legal text, however primitive and primal it may be, the right to define justice, It is the religion of justice, which differentiates between equals on all organic bases, i.e., between male and female.

  Religious justice ignores or is ignorant of the fact that man and woman are human beings, and that represents the essence of equality in humanity regardless of membership, The fact that woman is a biological female and man is a biological male is not a justification for considering them socially as two things that are not equal in rights, such as the right to equality in inheritance or the equality of a woman’s testimony with a man’s, and then in many other areas, which there is no need to mention in detail.

The Sharia is utterly absurd, especially when it is said that equality cannot be just. How can equality not be just when all of humanity calls for equality, with the exception of parts of the societies in this wretched region? It is the height of absurdity and moral deficiency to give the male twice the inheritance given to the female, as if the female were the daughter of a slave and the male the son of a free woman, It is degrading that the woman needs a representative in marriage contract negotiations, while the man does not need one because he can represent himself, while the woman cannot, Why? It is ignorance and inferiority to consider equality as an attempt to eliminate the biological differences between men and women, as if those who call for the equality of men and women do not realize that women give birth while men do not. It is degrading to cite the verse that says, “The living and the dead are not alike” as a justification for practicing unjust social inequality. Women and men are social beings, not just biological creatures.

Among the merits of Islamic law is the principle that “a Muslim is not to be killed for killing a non-Muslim,” and the application of the death penalty and beheading for those who renounce the faith, Herein lies the ethical dilemma, as there is a difference between one victim and another, and between one killer and another, Here, the religious affiliation of each must be inquired about, because religious affiliation is related to the assessment of the form and type of punishment, If the killer is a Muslim and the victim is a non-Muslim living under Islamic rule (dhimmi), then the death penalty is not applied to the killer, However, if the killer is a non-Muslim living under Islamic rule and the victim is a Muslim, then woe to him! His head must be beheaded immediately, In the case of a Muslim who is the killer, blood money or fasting for two months suffices. Therefore, man-made laws should not contradict this tolerant and just Sharia, for it is the law of God, which does not err but is always correct
